PERSONNEL COMMITTEE

Meeting Held Tuesday, January 24, 2006

1.      Roll Call

 

2.        Adoption of the Agenda

A motion to adopt the agenda was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

 

3.     Approval of the Minutes of January 10, 2006
A
motion to approve the minutes from the meeting of January 10, 2006 was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

 

4.   Report of the Human Resources Department

 

a)       Position Fill Request – Justification Report

Attorney Hanson explained that senior staff had met and developed criteria by which requests to fill positions will be judged.  After discussion, a motion to receive and place on file the position fill request-justification report was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

b)       Recruitments

Attorney Hanson affirmed that the Clerk-Typist I position in Inspection has been to senior staff and approved per the criteria.  A motion to approve filling the Clerk I position in Inspection was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

 

Mr. Strong requested an unpaid intern for the Planning Department at no cost to the City.  A motion to approve the request by the Planning Director was made by Alderman Vander Leest, seconded by Alderman Graves, and carried.

     5.      Request of Chief VanSchyndle for off-time training.

The Chief presented the Committee with an overview of the course which Officer Roberts has requested to attend, and the valuable knowledge it would provide to the department at no cost to the City.  After discussion, a motion to approve the request of Chief VanSchyndle for off-time training of Officer Roberts, conditional upon minimum staffing not requiring overtime, was made by Alderman Vander Leest, seconded by Alderman Graves, and carried.

 

     6.      Request of the Transit Director for out-of-state travel. 

      Mr. Nennig explained he has been asked to attend the AGRIP Institute for Management and Leadership training session in August of this year in Montana at no cost to the City.    A motion to approve the request of the Transit Director for out-of-state travel to Montana in August of 2006 was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

 

7.     Request of Human Resources for an unpaid intern.

After discussion, a motion to approve the request of Human Resources for an unpaid intern was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

8.     Grievance:  Police Union, Packer Lights

The Committee may convene in closed session pursuant to §19.85(1)(e), Wis. Stats., for the purpose of deliberating or negotiating public employee contracts for competitive for bargaining reasons.  The Committee may, thereafter, reconvene in open session pursuant to §19.85(2), Wis. Stats. to report any actions taken during closed session and to consider all other matters on the agenda.

 

Attorney Morrison informed the Committee that Alderman Weber was presented with a document stating the union’s position on this grievance, which is out of order and to which he objected on the grounds he was never given the document prior to the meeting.  He advised the Committee that, if they wished a hearing, this document could be included with the City being copied, then advised them of their other options.  Alderman Weber stated for the record that he had no prior knowledge of this document and did not distribute it to the Committee until moments ago.

 

A motion to convene in closed session was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

 

A motion to reconvene in open session was made by Alderman Vander Leest, seconded by Alderman Graves, and carried.

 

The Committee voted to deny the grievance.

A motion to suspend the rules and to consider items numbered 9, 10 & 11 as a whole was made by Alderman Vander Leest, seconded by Alderman Graves, and carried.

 

9.         Request by the City Attorney to adopt the “City of Green Bay-Notice under the Americans with Disabilities Act”.

 

10.       Request by the City Attorney to adopt the “City of Green Bay – Grievance Procedure under the Americans with Disabilities Act.”

 

11.       Request by the City Attorney to update the Green Bay Policy Manual, Recruitment and Selection Chapter related to ADA Compliance.

 

A motion to adopt & update items numbered 9, 10 & 11 was made by Alderman Vander Leest, seconded by Alderman Graves, and carried.

 

12.       Report by the City Attorney regarding the request by Alderman Nelson to investigate solicitation of political pressure on public officials by Transit employees during the budget process.

 

Attorney Hanson distributed documents which he had located related to this investigation.  He reported that the documents were, indeed, located on the bus but could find no evidence the bus drivers had distributed them.  The first three documents distributed displayed public information.  The fourth document, listing each alderperson and their yea or nay vote on the Transit funding issue looks to be political.  Attorney Hanson reported that a lady had boarded the bus and while riding overheard a conversation regarding Transit funding.  She then asked a question and was handed this fourth document by another passenger.  Attorney Hanson went on to address City policies, stating he could find no policy violation.  He suggested strengthening our existing policy to prevent employees from distributing political materials on City time.  Alderman Nelson made a motion to have the Law Department refine City policy to prevent employees from distributing political materials while on City time.  Attorney Hanson suggested utilizing the phrase ‘political advocacy’.  Alderman Nelson informed the Committee that he had conducted some research and found it is not uncommon for a company to require management approval on all employee-distributed materials done on company time.  Alderman Weber thought, perhaps, management should be given discretion to approve or disapprove distribution of materials.  After further discussion, Alderman Nelson’s motion was seconded by Alderman Vander Leest, and carried.

 

13.       Report of Personnel Actions for regular employees and seasonal Park dept.
      employees.

 

A motion to receive and place on file the report of personnel actions for regular employees and seasonal Park dept. employees was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.

 

There being no further business, a motion to adjourn was made by Alderman Vander Leest, seconded by Alderman Nelson, and carried.
